OpenPitch Terms of Use

Important notice
OpenPitch is an Agency directory and discovery platform. It helps Users discover Agencies, compare profiles, save Agencies and visit their websites.
WWWONDER LTD does not provide the services advertised by Agencies and is not a party to any agreement, project or transaction between a User and an Agency.
Any engagement, contract, statement of work, payment, deliverable, intellectual-property arrangement or dispute relating to Agency services is solely between the User and the relevant Agency.
1. About these Terms
These Terms of Use govern your access to and use of:
- the OpenPitch website at https://openpit.ch;
- OpenPitch accounts, Agency profiles and dashboards;
- the directory, search, %Finder, Leaderboard and other discovery features;
- %Discovery, referral links, analytics and related notifications;
- Saved Agencies, shortlists and private notes;
- Agency subscriptions, plan features, boost credits and paid placements; and
- any other OpenPitch service that links to these Terms.
In these Terms:
- “OpenPitch”, “we”, “us” or “our” means WWWONDER LTD;
- “Agency” means a business or service provider displayed on or using OpenPitch;
- “Agency User” means someone claiming, creating or managing an Agency profile;
- “Discovery User” means someone using OpenPitch to find, save or contact Agencies;
- “User” or “you” means any person accessing or using OpenPitch; and
- “Services” means the OpenPitch website and its associated features.
By accessing or using OpenPitch, you agree to these Terms. If you create an account, claim an Agency profile or purchase a paid Service, you may also be asked to confirm your acceptance expressly.
If you do not agree to these Terms, you must not use OpenPitch.
Our Privacy Notice and Cookie Policy also apply to your use of OpenPitch.
2. Who operates OpenPitch
OpenPitch is operated by:

OpenPitch is a trading name used by WWWONDER LTD for the platform at openpit.ch.
3. Eligibility and authority
You must be at least 18 years old to create an account or purchase a paid Service.
If you create or manage an Agency account, you confirm that:
- you are acting for business purposes;
- you have authority to act for that Agency;
- the information you provide is accurate;
- you are authorised to publish the Agency’s name, branding, images, work and other profile content; and
- you are authorised to accept these Terms on the Agency’s behalf.
Agency subscriptions and boost-credit purchases are intended for business customers acting in the course of their trade, business or profession.
You must provide accurate account information and keep it up to date. You are responsible for activity occurring through your account and for keeping your login credentials secure.
Please contact us promptly at admin@openpit.ch if you believe your account has been accessed without permission.
4. What OpenPitch does
OpenPitch provides tools through which Users can:
- browse and search for Agencies;
- view Agency profiles and portfolio images;
- compare Agencies by discipline, location and other available criteria;
- receive algorithmic or AI-assisted suggestions;
- save and shortlist Agencies;
- keep private text notes about saved Agencies;
- visit an Agency’s external website or social-media pages; and
- contact or engage an Agency outside OpenPitch.
Agency Users may also be able to:
- claim and manage an Agency profile;
- view permitted analytics and discovery information;
- receive %Discovery notifications and improvement suggestions;
- share tracked referral links;
- subscribe to a paid plan; and
- use included or separately purchased boost credits.
We may add, remove or change features as OpenPitch develops.
5. OpenPitch is not a party to Agency engagements
OpenPitch is a discovery service. We are not an Agency, agent, broker, adviser, consultant, employer, representative, partner or guarantor of any Agency or Discovery User.
We do not negotiate, approve, supervise or become a party to agreements between Users and Agencies.
If you decide to work with an Agency, you and the Agency are solely responsible for agreeing matters including:
- the project scope and deliverables;
- fees, expenses, taxes and payment schedules;
- timelines, milestones and approval processes;
- ownership and licensing of intellectual property;
- confidentiality and data protection;
- warranties, revisions, cancellations and refunds;
- regulatory or industry-specific requirements; and
- the process for resolving complaints and disputes.
WWWONDER LTD is not responsible for an Agency’s conduct, availability, financial position, suitability, statements, work, deliverables, omissions, fees or failure to perform.
Any complaint or dispute concerning Agency services must be addressed directly between the User and the Agency. We are not required to mediate or resolve such disputes, although we may consider reports about misuse of OpenPitch or breaches of these Terms.
You should carry out your own checks before appointing an Agency and enter into an appropriate written agreement with it.
6. Agency profiles and human review
Agency profiles may contain information supplied by the Agency, collected from publicly available sources or provided by authorised third parties.
An unclaimed profile does not mean that the Agency has approved, endorsed or entered into a relationship with OpenPitch.
OpenPitch may conduct a human review of a listing for creative relevance, directory fit and the work presented. This review is not legal, financial, regulatory or professional due diligence.
Unless we state otherwise explicitly, inclusion in the directory does not mean that we have:
- verified an Agency’s skills, personnel, clients or portfolio;
- checked its financial or legal status;
- assessed whether it is suitable for a specific project;
- confirmed that its information is complete or current; or
- guaranteed its services or future performance.
Any “verified” status or similar label applies only to the specific matter identified, such as control of an account, email address or website. It is not a general endorsement, accreditation or guarantee of the Agency or its services.
Agencies must ensure that their profiles remain accurate, lawful and not misleading. We may amend, suspend, unpublish or remove information that we reasonably believe is inaccurate, unlawful, outdated, infringing or inconsistent with these Terms.
An Agency may contact admin@openpit.ch to ask about claiming or correcting its profile.
7. Discovery, rankings and %Discovery
OpenPitch uses automated systems to organise and present Agencies across features such as search, the directory, %Finder, Leaderboard, homepage discovery sections and other recommendations.
What %Discovery means
%Discovery is a relative visibility indicator. It estimates an Agency’s opportunity to be discovered through eligible OpenPitch discovery surfaces compared with other eligible Agencies on the platform at that time.
It is not:
- a guaranteed statistical probability;
- a promise of a particular number of appearances, visits, enquiries or projects;
- a measure of an Agency’s quality or commercial value; or
- a guarantee that an Agency will be selected or contacted.
An Agency’s %Discovery may rise or fall when its information or performance changes, when other Agencies’ performance changes, when platform traffic changes or when we update the discovery methodology.
Organic performance
The principal factors used for organic ranking may include:
- eligible profile views;
- verified organic clicks;
- genuine visits attributed through an Agency’s shared referral link;
- recent engagement over a rolling period, normally the previous 90 days;
- profile completeness and freshness;
- relevance to a User’s search, filters or requirements;
- Agency eligibility and availability; and
- measures intended to give new or less-established Agencies a reasonable opportunity to appear.
Only clicks and activity that pass our validity and abuse checks may count.
References to “referrals” mean visits attributed through an Agency’s shared OpenPitch link. They do not mean that the visitor, lead or resulting business has been verified by OpenPitch. It is the associated organic click that may be verified, not the referral or resulting business opportunity.
Sharing an OpenPitch referral link with a genuine audience can contribute to organic performance. Artificial, purchased, automated, misleading or manipulated traffic will not count and may result in adjustments or account restrictions.
Click thresholds and discovery eligibility
Where an Agency reaches an applicable organic click or visibility threshold, it may become temporarily ineligible for general discovery surfaces, including:
- homepage discovery sections;
- the Leaderboard;
- directory browsing; and
- %Finder results.
Its profile may remain live and accessible:
- through a direct profile link;
- through a search for the Agency by name; and
- from a User’s Saved or Shortlist section.
Thresholds are intended to distribute discovery opportunities across the Agency community. Their values and operation may change as the platform and audience develop.
Paid and plan-based visibility
Paid boosts and other paid placements are separate from organic ranking and will be identified as “Boosted” or with an equivalent clear label.
Subscription plans may include different discovery features or boost-credit allocations, as described on the current Plans page. Unless expressly stated in the current methodology, purchasing a subscription or boost does not alter the organic Leaderboard score.
We may test and improve the ranking and discovery systems. Material changes to the principal ranking factors will be reflected in our published methodology or communicated to affected Agency Users where reasonably practical.
8. AI-assisted features
OpenPitch may use automated or AI-assisted systems to support search, matching, classification or recommendations.
These outputs may be incomplete, unsuitable or inaccurate. They are provided as discovery aids and are not professional advice or a guarantee that an Agency is suitable for a particular project.
Users should review Agency profiles and perform their own assessment before making decisions.
You must not attempt to manipulate automated systems through misleading profile information, keyword stuffing, artificial engagement or other deceptive activity.
9. Saved Agencies, shortlists and private notes
Discovery Users may be able to save Agencies, add them to a shortlist and create private text notes.
These features are provided as simple organisational tools. They are not a customer-relationship-management service, formal project record or secure document-storage service.
Private notes:
- are visible only within the relevant User’s account unless disclosure is required by law or reasonably necessary to operate or protect the Services;
- are not shared with the Agency through the normal operation of OpenPitch;
- must be lawful and must not be abusive, defamatory or infringe another person’s rights; and
- should not contain payment-card information, passwords, highly sensitive personal information or confidential material that the User is not authorised to store.
Users should retain their own copies of important project or contact information. We cannot guarantee that Saved items, shortlists or notes will be retained indefinitely.
Saving, shortlisting or adding notes to an Agency does not influence its organic ranking, %Discovery, click threshold, referral performance or boost allocation.
10. Referral links and traffic integrity
Agency Users may share their OpenPitch referral links through websites, social media, emails or other lawful channels.
You may not:
- generate clicks using bots, scripts, click farms or automated systems;
- repeatedly click your own links to manipulate metrics;
- purchase traffic whose purpose is to inflate OpenPitch performance;
- offer misleading or undisclosed incentives for clicks;
- use spam, unlawful direct marketing or deceptive messages;
- obscure the destination or misrepresent your relationship with OpenPitch; or
- coordinate artificial traffic with another person.
We may filter or remove invalid activity, recalculate metrics, withhold benefits, restrict features or suspend accounts where we reasonably suspect manipulation.
Traffic figures and analytics are estimates and may differ from information reported by external analytics services.
11. Agency plans and subscriptions
If and when paid plans are available, the Plans page and checkout will show the current:
- plan features;
- monthly or annual price;
- applicable taxes;
- billing period;
- included boost credits;
- additional-credit discount;
- renewal arrangements; and
- cancellation process.
Prices are shown in US dollars unless the checkout states otherwise.
Where an annual price is displayed as a monthly equivalent, it represents the annual subscription price divided by 12. The full annual amount will be charged at the start of the annual billing period unless checkout clearly states otherwise.
Paid plans renew automatically for the selected monthly or annual billing period until cancelled.
Cancel anytime
You may cancel a paid plan at any time through the available account or billing controls or by contacting admin@openpit.ch.
Cancellation stops the next automatic renewal. Unless the Plans page, checkout or applicable law states otherwise:
- you will retain paid-plan access until the end of the current paid billing period;
- cancellation does not retrospectively refund the current billing period; and
- monthly-equivalent annual pricing does not turn an annual purchase into a monthly contract.
We may change plan prices or features. Where a change materially affects an existing paid subscription, we will provide reasonable notice before the change applies to a future renewal.
12. Boost credits and additional-credit discounts
Boost credits may be included with a paid plan or purchased separately.
Included plan credits are granted according to the current plan description. Separately purchased credits are one-time purchases and do not replenish automatically.
The current plan-based fee reductions for purchases of additional boost credits are:
- Free: 0% reduction;
- Base: 10% reduction;
- Middle: 15% reduction; and
- Top: 20% reduction.
The reduction is applied to the standard additional-credit price available at the time of purchase. It does not apply retrospectively and cannot be exchanged for cash.
Boost credits:
- are linked to the relevant Agency account;
- are non-transferable unless we agree otherwise;
- have no cash value;
- may only be used for eligible OpenPitch boost features; and
- do not guarantee a particular number of clicks, enquiries, conversions or projects.
Any expiry terms will be displayed on the Plans page, in the boost workspace or at checkout before purchase.
Paid placements must remain clearly identifiable as Boosted. Users must not attempt to disguise a paid placement as an organic result.
13. Payments
Payments may be processed by Stripe or another payment provider identified at checkout.
By submitting payment details, you authorise the relevant recurring or one-time charges described at checkout. Payment processing may also be governed by the payment provider’s terms and privacy notice.
You are responsible for providing current billing information and paying applicable taxes unless the checkout states that they are included.
Except where required by law, stated at checkout or agreed by us, paid Agency subscription periods and used or allocated boost credits are non-refundable.
If a payment fails, we may retry the payment, ask you to update your payment method or restrict paid features until payment is received.
14. User Content
“User Content” includes profile copy, logos, portfolio images, project descriptions, links, notes, account information and other material submitted to OpenPitch.
You retain ownership of your User Content.
For content intended to appear publicly, you grant WWWONDER LTD a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, resize, crop, display and distribute that content:
- to operate the OpenPitch Services;
- to display and promote the relevant Agency profile;
- to produce previews and social-sharing material; and
- to market OpenPitch and its directory.
This licence continues for as long as the content is used on OpenPitch and for a reasonable period in backups, archives and previously produced promotional material.
You confirm that you have the necessary rights and permissions to submit the content and grant this licence.
You must not upload content that:
- infringes copyright, trademark, privacy or other rights;
- contains confidential information without permission;
- is false, misleading, defamatory, abusive or discriminatory;
- contains malware or harmful code;
- is unlawful or promotes unlawful activity; or
- misrepresents an Agency’s work, clients, team or capabilities.
15. OpenPitch intellectual property
OpenPitch, its design, software, database structure, written content, ranking systems and branding are owned by or licensed to WWWONDER LTD.
Except where permitted by law, you must not:
- copy or republish substantial parts of the directory;
- scrape, harvest or systematically extract platform data;
- reverse engineer or interfere with the Services;
- use OpenPitch content to create a competing directory or dataset;
- use OpenPitch branding in a way that suggests endorsement or affiliation; or
- remove copyright, attribution or rights notices.
You may link to public OpenPitch pages and share the referral tools we provide, provided you do so lawfully and do not misrepresent your relationship with us.
Agency names, logos and portfolio materials remain the property of their respective owners.
16. Acceptable use
You must not use OpenPitch:
- unlawfully, fraudulently or deceptively;
- to impersonate another person or Agency;
- to compromise another account;
- to upload malicious code;
- to probe, overload or disrupt the platform;
- to collect personal information without a lawful basis;
- to send spam or unlawful marketing;
- to manipulate rankings, %Discovery, clicks or referrals;
- to bypass eligibility rules, limits or security controls; or
- to harass, threaten or harm another User.
You must not create multiple or misleading accounts to avoid restrictions.
17. Reporting content and intellectual-property concerns
If you believe that a profile or other content is inaccurate, unlawful or infringes your rights, contact admin@openpit.ch with:
- your name and contact details;
- the URL or profile concerned;
- a clear explanation of the issue;
- evidence of your rights or authority where relevant; and
- the outcome you are requesting.
We may request additional information. We may restrict or remove content while reviewing a report but are not required to determine private legal disputes between Users.
Knowingly submitting false or abusive reports is prohibited.
18. Suspension and termination
You may stop using OpenPitch at any time. Account holders may request account deletion through the available settings or by contacting us.
We may restrict, suspend or terminate access where reasonably necessary because:
- these Terms have been breached;
- an account presents a security, fraud or legal risk;
- required fees remain unpaid;
- traffic or metrics appear to have been manipulated;
- profile content is unlawful, misleading or infringing;
- continued access may harm Users, Agencies or OpenPitch; or
- we are required to do so by law.
Where appropriate, we will explain the reason and provide a reasonable opportunity to correct the issue or contact us. Immediate action may be taken where necessary to protect the platform, other people or legal rights.
Deleting a Discovery User’s account will remove or anonymise its personal account information in accordance with our Privacy Notice. It will also remove Saved items, shortlists and private notes, subject to legal retention requirements.
Deleting an Agency User’s login does not automatically delete the underlying Agency listing, which may remain as an unclaimed public directory profile.
19. Availability and changes to the Services
We aim to keep OpenPitch available but do not guarantee continuous or error-free access.
We may suspend access for maintenance, security, technical, legal or operational reasons. Features and content may change as the platform develops.
We are not responsible for failures caused by events outside our reasonable control, including internet failures, hosting outages, cyberattacks, utility failures or third-party service interruptions.
20. Third-party websites and services
OpenPitch contains links to Agency websites, social-media pages, payment providers and other third-party services.
We do not control and are not responsible for their availability, security, content, privacy practices, products or services. A link does not constitute an endorsement.
Your use of a third-party service is governed by that third party’s own terms and policies.
21. Disclaimers
We use reasonable care in operating OpenPitch. However, to the extent permitted by law:
- directory and profile information is provided on an “as available” basis;
- we do not guarantee that listings are complete, current or error-free;
- we do not guarantee that any Agency is suitable, solvent, available or properly insured;
- we do not guarantee discovery levels, rankings, traffic, leads, revenue or project outcomes; and
- metrics, recommendations and AI-assisted outputs may contain errors.
Nothing on OpenPitch constitutes legal, financial, procurement, technical or professional advice.
Nothing in these Terms affects rights that cannot lawfully be excluded.
22. Our responsibility to you
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot lawfully be excluded or limited.
Agency Users and other business Users
If you use OpenPitch for business purposes, WWWONDER LTD will not be liable for:
- any agreement, work or dispute between a User and an Agency;
- loss of profits, revenue, business, contracts, anticipated savings, goodwill or opportunity;
- loss or corruption of data;
- indirect or consequential loss; or
- loss arising from information supplied by an Agency or another third party.
Subject to liabilities that cannot be excluded, our total aggregate liability arising from the Services during any 12-month period will not exceed the total amount you paid to OpenPitch during the 12 months immediately preceding the event giving rise to the claim.
Consumers
If you use OpenPitch as a consumer, we are responsible for foreseeable loss or damage caused by our failure to use reasonable care and skill or by our breach of these Terms.
We are not responsible for loss that was not foreseeable, for business losses or for loss caused by an Agency or a separate agreement between you and an Agency.
Your statutory consumer rights are not affected.
23. Agency responsibility and indemnity
If you are an Agency User, you are responsible for your Agency profile, User Content, referral activity and services supplied to Users.
To the extent permitted by law, you will reimburse WWWONDER LTD for reasonable losses, liabilities, damages and costs arising from a third-party claim caused by:
- your Agency services;
- your User Content;
- your infringement of another person’s rights;
- your unlawful or misleading conduct; or
- your material breach of these Terms.
This clause does not apply to the extent that the claim was caused by WWWONDER LTD’s own breach or negligence.
24. Privacy, cookies and communications
Our handling of personal information is explained in the OpenPitch Privacy Notice. Our use of cookies and similar technologies is explained in the Cookie Policy.
We may send essential account, security, billing and service messages where necessary to operate your account.
Where permitted and subject to your preferences, we may also send:
- %Discovery updates;
- profile-improvement suggestions;
- platform news; and
- promotional or plan-related messages.
Where consent is required for optional marketing, it will be requested separately and may be withdrawn at any time.
25. Changes to these Terms
We may update these Terms to reflect changes to:
- the Services;
- subscriptions or boost features;
- legal or regulatory requirements;
- security practices; or
- our business operations.
The latest version will be published on openpit.ch with its effective date.
If a change materially affects an account holder’s rights or paid Services, we will provide reasonable notice by email or through the platform where practical.
Continuing to use OpenPitch after the updated Terms take effect constitutes acceptance of the updated Terms. Where required, we will ask you to accept them expressly.
26. Governing law and courts
These Terms are governed by the laws of England and Wales.
If you are a business, the courts of England and Wales will have exclusive authority to resolve disputes relating to these Terms or the OpenPitch Services.
If you are a consumer, you retain any mandatory rights provided by the law of the country in which you live and may be entitled to bring proceedings in your local courts.
This section does not govern contracts entered into directly between a User and an Agency. Those contracts are governed by the terms agreed between those parties.
27. General provisions
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
A delay in enforcing a right does not waive that right.
You may not transfer your account or rights under these Terms without our written consent. We may transfer our rights and obligations as part of a reorganisation, sale or transfer of the OpenPitch business, provided this does not reduce any mandatory rights.
These Terms, together with the policies and checkout terms referred to in them, form the agreement between you and WWWONDER LTD regarding OpenPitch.
No person other than you and WWWONDER LTD has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
